Conditions of Participation for the Dorint Bonus Program

I. Scope of services and organizer of the Dorint Bonus Program

The organizer of the Dorint Bonus Program is Dorint GmbH, Aachener Straße 1051, 50858 Cologne, Germany (hereinafter referred to as "Dorint"). By participating in the Dorint Bonus Program, the Dorint Cardholder (hereinafter referred to as the "Participant") has the opportunity to collect Dorint Bonus Points when staying at hotels and resorts participating in the Dorint Bonus Program, which can be exchanged for overnight and non-cash rewards or donated to charity.

Further details on the accommodation rewards are set out below. Using the Dorint Card membership number and associated password, participants can book rooms at a discounted member rate during a regular booking process, subject to availability, to be selected during the booking process when choosing the desired rate. The member rate is limited to simultaneous bookings of a maximum of two rooms and can only be used if the Dorint Card Bonus Program member whose Dorint Card number is used in the booking process is also traveling. In addition, each Dorint Cardholder enjoys special privileges during their stays in one of the participating hotels and resorts according to their membership status. Unless expressly stated otherwise, these conditions of participation apply to all Dorint Cardholders regardless of their membership status (Dorint Card with Basic or Premium status), and the hotels and resorts participating in the Dorint Bonus Program are advertised on the Dorint website at dorint.com. II Conditions of participation in the Dorint bonus program

1 Participation and status of the Participant

1.1 Only individual natural persons who have reached the age of 18 may participate in the Dorint Bonus Program. Companies, legal entities, other organizations and groups as well as employees of Dorint and companies affiliated with Dorint are not eligible to participate. Multiple registrations by individuals are not permitted. There is no legal entitlement to participate in the Dorint Bonus Program. In addition, a valid e-mail address is required to participate in the bonus program. Changes to the e-mail address or postal address must be communicated to Dorint GmbH immediately or updated online on the Dorint member portal website in the customer account

1.2 Participation in the Dorint Bonus Program is free of charge. In order to become a participant, the guest must complete the relevant application form in full, taking into account all required mandatory fields. After Dorint has received the complete application form and checked it accordingly, the participant will receive his/her personal Dorint Card number by e-mail. Points for the Dorint bonus program will be credited upon receipt of the application by Dorint; only after confirmation of the link in the e-mail with the personal digital Dorint Card will all other functions of the personal digital card be activated. The personal Dorint Card is non-transferable, Dorint Cards in the form of previously issued plastic cards remain the full property of Dorint. In the event of loss of the Dorint Card number, the Participant must inform Dorint immediately. Dorint will then issue the Participant with a digital replacement card free of charge upon request.

1.3 The Participant's status depends on the amount of revenue or the number of overnight stays generated by the Participant in the participating hotels and resorts. No minimum turnover is required to acquire the Dorint Card with Basic status. A Participant receives the Dorint Card Premium if, within a consecutive period of twelve months from receipt of the application by Dorint, he/she has either personally spent at least 30 overnight stays in at least three different Dorint Hotels & Resorts or has settled invoices amounting to at least EUR 6,000.00 in at least three different hotels and resorts. A holder of the Dorint Card Premium who has not generated the aforementioned minimum turnover or the minimum number of overnight stays in the following 12 months will receive the Dorint Card with Basic Status.

2 Acquisition of Dorint bonus points

2.1 It is possible to collect Dorint Bonus Points from receipt of the application (see I. 1.2). In order for the Participant to be credited with bonus points for his/her stay, the Participant must provide his/her personal Dorint Card number when making the room reservation. Subsequent crediting of Dorint bonus points is only possible within two months of the end of the stay in question. Bonus points from stays in participating hotels and resorts that were earned prior to Dorint's receipt of the completed Dorint Card application, i.e. prior to participation in the Dorint Bonus Program, cannot be credited.

2.2 The Participant will receive 3 Dorint Bonus Points for every EUR 1.00 spent in the room booked by him/her in participating hotels and resorts. For rooms that the Participant books and pays the bill for himself/herself, but in which he/she does not stay overnight, the Participant will receive Dorint Bonus Points if the persons staying there are relatives of the Participant traveling with him/her. Only spouses/life partners, children and grandchildren as well as parents of the participant are considered relatives. In addition to revenue from overnight stays, revenue from food and beverages paid for by the participant (if offered by the hotel and/or resort in its own name and on its own account) shall be taken into account. However, sales for food and beverages will only be taken into account if a room reservation has been made for which the participant also receives Dorint bonus points. You are welcome to contact the Dorint Card Service Center at any time to find out whether your desired booking or service is eligible to collect Dorint bonus points. Foreign currencies are converted internally on the basis of the applicable exchange rate and rounded up or down according to commercial rules.

2.3 The Participant will not receive Dorint bonus points for

a) services booked via tour operators or travel agents or for which the Participant receives a voucher from the tour operator or travel agent

b) Stays charged at special rates, e.g. special rates for travel agents, crews/airlines, etc.

c) all sales, including overnight stays, generated in the context of conferences, events and organized group stays d) all overnight stay bonuses or hotel services used via Dorint bonus points

e) the purchase of vouchers and the use of services paid for with a voucher

f) overnight stays and the directly associated ancillary services (e.g. final cleaning) if these are in connection with owner coupons.

g) Revenues for other ancillary services (such as spa treatments, parking fees, visitor's tax, etc.)

If miles/points are credited to the Participant for a stay in participating hotels and resorts as part of a frequent flyer program, Dorint bonus points will not be credited at the same time.

2.4 The assignment or pledging of Dorint Bonus Points and Dorint Privileges to other participants in the Dorint Bonus Program or to third parties is excluded.

2.5 Dorint manages the Participants' bonus point accounts in a central database. The Participant can inquire about the current status of the Dorint bonus points collected by him/her at any time by calling the Dorint Card Service Center on +49 221 48567-222 or online on the website https://dorintcard.dorint.com/de/loyalty in the Dorint Card customer account using the personal access data.

3. redemption of Dorint bonus points

3.1 Dorint Bonus Points can only be redeemed for accommodation and non-cash rewards advertised on the Dorint website or in other special publications of the Dorint Bonus Program, and then only under the conditions specified therein. Alternatively, participants can donate their Dorint bonus points to a charity partner of Dorint from the minimum number of points required (currently from 1,000 points). However, corresponding donation receipts will not be issued.

3.2 The non-cash rewards and the donations can be viewed online on the website https://dorintcard.dorint.com/de/loyalty in the Dorint Card customer account using the personal access data and redeemed with bonus points. The accommodation rewards can be booked using the Dorint Card membership number and the corresponding password at https://dorintcard.dorint.com/de/loyalty. 3.3 Reward services are subject to availability at the time of ordering. If the desired reward is not available, Dorint will inform the Participant immediately and offer an alternative. This also applies to non-cash rewards which cannot be sent to a country outside the European Union (EU) due to legal regulations. Dorint will send non-cash rewards free of charge to the Participant within the EU. If a shipment is not made within the EU, the employees of the Dorint Card Service Center will discuss the shipment with the Participant and inform him/her of the shipping costs to be borne by him/her. If it is not possible to deliver an ordered Reward within or outside the EU, the Participant shall bear the costs of resending the Reward.

3.4 Any taxable monetary benefit associated with the receipt of the Reward will be taxed at a flat rate by Dorint and borne by Dorint.

3.5 Dorint Bonus Points collected are valid for a period of 36 months after purchase. If the Dorint bonus points are not redeemed during this period, they will expire without replacement at the end of the next quarter. The expiry of Dorint bonus points is not based on the respective day of crediting, but on the points collected on a quarterly basis. Dorint will not provide separate information on the pending expiry of points.

3.6 The conversion of Dorint bonus points into a monetary value and their payment in cash or offsetting are excluded. Dorint rewards can only be exchanged to a limited extent; non-cash rewards cannot be exchanged. In the case of overnight awards that have already been booked but not used, the respective Dorint bonus point value will only be credited back to the participant's account if the Dorint cardholder cancels the award overnight stay in good time in compliance with the cancellation deadlines of the participating Dorint hotels and resorts. In the event of late cancellation, the Dorint bonus points accumulated for this will be forfeited without compensation.

3.7 Only a limited number of rooms are available for the overnight stay bonuses. Therefore, overnight stays can only be redeemed on request and subject to availability and prior booking confirmation. The overnight stay rewards are valid in the participating hotels and resorts and include an overnight stay in a single room or double room in the booked category including breakfast for a maximum of 2 persons.

III Other provisions for the Dorint Bonus Program

1. termination of participation

1.1 Participation in the Dorint Bonus Program may be terminated by either party at any time without notice and without stating reasons, in particular in the event that Dorint replaces the program with another one. The Participant may give notice of termination by post to: Dorint GmbH, Dorint Card Service Center, Aachener Straße 1051, 50858 Cologne, Germany, by e-mail to: dorintcard(at)dorint.com or by fax to: +49 221 48567-148. Points balances existing at the time of termination will automatically be donated to the Dorint Charity Partner. Unless, instead of a donation, a bonus redemption for the remaining points is desired. This request must be communicated to Dorint GmbH immediately upon or after receipt of the notice of termination. Dorint bonus points cannot be transferred to another (existing or newly opened) participant account.

1.2 Dorint reserves the right to extraordinary termination without notice for good cause. Good cause shall be deemed to exist in particular in the event of a culpable and serious breach of the Terms and Conditions of Participation by the Participant. The same applies in the event of misuse or material misrepresentation. Misuse shall be deemed to exist in particular in the event of a breach of II. 2.4.

1.3 Upon the death of a Dorint cardholder, his/her participation in the Dorint bonus program ends. In this case, any Dorint bonus point balance of the Participant will be donated to Dorint's charity partner.

2. program changes Dorint reserves the right to make changes or additions to the Dorint Bonus Program and the associated conditions of participation and the rewards contained therein at any time, whereby Dorint will take the interests of the Participants into account appropriately and the Participants will not be unreasonably disadvantaged. Dorint will inform the Participants exclusively by e-mail in text form of the amendments or additions to the Terms and Conditions of Participation and point out the legal consequences of an objection or failure to object. The amendments or additions shall then be deemed to have been approved by the Participant and shall become part of the contract if the Participant does not object to them in writing to Dorint within one month of becoming aware of them.

3 Liability

Dorint is liable without limitation for intent and gross negligence. Dorint is only liable for simple negligence - except in the case of injury to life, limb or health or in mandatory legal cases, e.g. in accordance with the Product Liability Act - if essential contractual obligations (cardinal obligations) are breached. Essential contractual obligations are those obligations whose fulfillment is essential for the proper execution of the contract and on whose compliance the contractual partner relies and may also rely. Insofar as liability is excluded or limited above, this also applies to the personal liability of Dorint's employees, workers, representatives, organs and vicarious agents.

4 Applicable law

The law of the Federal Republic of Germany shall apply exclusively.
